Death of a Good Name – Defamation and the Deceased: A Consultation Paper

This consultation paper was published in January 2011.

“The 2006 consultation paper, Making Sure That Crime Doesn’t Pay, noted that ” the issue of defamation of homicide victims is not discussed in this consultation but it remains under consideration separately with a view to possible consultation in the context of other work on defamation…“. Subsequently, much attention has been devoted to this issue by the Public Petitions Committee of the Scottish Parliament and consideration of Public Petition PE504, which was lodged in May 2002 has led to the Committee’s conclusion that a Scottish Government consultation exercise is the appropriate way to take this issue forward. Report on evaluation of in-court mediation pilots in Glasgow and Aberdeen Sheriff Courts

This report was published on 26th April 2010.

“The Scottish Executive in 2005 announced the establishment of in-court mediation pilots in Glasgow and Aberdeen Sheriff Courts to run for a period of two years commencing in 2006. The pilots ran from March 2006 to July 2008, having been carried forward by the Scottish Government. The pilot services were delivered by Court Mediation Services Ltd, a company formed by an experienced commercial provider of mediation, after a process of tendering. Funding for the pilot services was provided by the Scottish Government, but parties were to contribute to the cost of mediation on a sliding scale according to claim value in summary cause and ordinary civil cases. The pilots were evaluated by the research team from University of Aberdeen School of Law and DTZ.”

Review of the Glasgow and Fife Drug Courts

This report was published on 22nd April 2010.

“Pilot Drug Courts were introduced in October 2001 in Glasgow and in August 2002 in Fife. Following broadly positive evaluations of the pilot schemes in 2006 Scottish Ministers agreed to continue funding the Drug Courts for a further 3 years until Spring 2009. The purpose of this review is to assess the impact and effectiveness of the two Drug Courts, including cost effectiveness, in light of the impact of the summary justice reforms. This will inform future policy and funding regarding Drug Courts.”

Law Commission Report: Reforming Bribery

The Law Commission for England and Wales issued this report today. It outlines their recommendations for updating English law on bribery.

“Bribery has been contrary to the law at least since Magna Carta declared, “We will sell to no man … either justice or right”. Most people have an intuitive sense of what “bribery” is. However, it has proved hard to define in law. The current law is both out-dated and in some instances unfit for purpose.”

Rumours are unfounded that it is being published in brown paper bags and distributed in service station car parks.
